1. Acceptance of Terms
By accessing or using the services provided by ZPK Digital ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services. These terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
ZPK Digital provides an AI-driven customer engagement platform, including but not limited to chat widgets, knowledge base management, and automated response systems ("the Service"). We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.
3. User Accounts
To use our Service, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.
4. Payments and Subscriptions
Access to certain features of the Service requires a paid subscription. All payments are processed securely via our third-party payment processor, Stripe.
- Billing: You will be billed in advance on a recurring and periodic basis (monthly or annually).
- Tax: All fees are exclusive of taxes, which will be charged where applicable.
- Payment Methods: We accept major credit cards and other payment methods supported by Stripe. We do NOT store your full credit card information on our servers.
5. Intellectual Property
All software, algorithms, designs, and content provided through the Service are the exclusive property of ZPK Digital or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service for your business purposes. You may not reverse-engineer, decompile, or attempt to extract the source code of our software.
6. User Content & Knowledge Base
You retain all rights to the data and content you upload to the Service ("User Content"). By uploading content, you grant ZPK Digital a worldwide, royalty-free license to use, store, and process your content solely for the purpose of providing the Service to you.
7. Limitation of Liability
To the maximum extent permitted by law, ZPK Digital shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use the Service, including loss of profits, data, or business reputation.
8. Termination
We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.
